Qld Breeders Urged To Join EI Class Action
Solicitor Jeff Garrett from Attwood Marshall Lawyers (the firm co-ordinating a potential class action for compensation following last year's equine influenza crisis) advised Thoroughbred Breeders Queensland: "We have received a response from Minister Burke's office advising they have referred the matter to the Commonwealth Insurers, Comcover. We have also received a response from Comcover requesting additional details. Although the correspondence does not state or imply in any way that they are prepared to pay any compensation or accept liability for the claims, they have requested the grounds upon which we believe the Commonwealth is liable for the losses along with details of individual claims. We appreciate that a large number of you have completed & returned the questionnaire, along with supporting financial documents, but there is also a large number who have not supplied any details. Could everyone who hasn't supplied their information to us, please provide this information as soon as possible. As stated in previous letters, do not be concerned by the fact that you do not have all of the information, we simply require: (1) Confirmation you wish to proceed & be included in the class action; (2) An outline of losses caused by the EI outbreak (this can take any form you like, simply give us an outline of what your loss is & we will contact you for any further information needed). We would like to finalise those of you who wish to proceed with claims to assist us with negotiating with Comcover."
