NSW Govt Moves To Stop Documents For Betfair

The NSW Government "has filed an urgent appeal with the full Federal Court Of Australia to overturn a ruling that requires it to give documents to the James Packer-controlled betting exchange Betfair, which is challenging a turnover tax introduced by Racing NSW last year," reported The Australian Financial Review. The NSW Government "which considers the proceedings so important it has joined them as a party", tried to "keep the documents out of Betfair's hands on the basis of public interest immunity & legal professional privilege". However Justice Jayne Jagot rejected this argument, ordering that documents "including reports to the Board of Racing NSW, drafting instructions to parliamentary counsel & emails relating to draft legislation" be handed over. Her orders "have been suspended while an urgent full Federal Court appeal takes place" & 3 judges "are due to hear the appeal on Thursday".
