Nikolic Inquiry 1: Bailey Statement & Video Inadmissable
Victoria's Racing Appeals & Disciplinary Board chairman Judge Russell Lewis ruled Racing Victoria chairman of stewards Terry Bailey's statement & accompanying DVD, relating to 11 "questionable rides" by jockey Danny Nikolic, were inadmissible during yesterday's opening session of the headline-hogging RADB hearing in Melbourne, reported The Herald-Sun. Lewis agreed with a submission from Nikolic's barrister Richard Smith that Bailey "couldn't have his cake and eat it too". Smith said Bailey "seemed to have his feet on either side of the fence": he wasn't happy with 11 Nikolic rides, but had not charged him under Rules which deal with horses running on their merits & jockeys taking all reasonable & permissible measures to give a horse the best opportunity to win or obtain the best possible placing. Smith declared: "If there's evidence of a breach, then charge him & hear the charge. It's most unfair those suggestions are made in the absence of such charges."
