New York Court Dismisses Dutrow Appeal
The New York Court has dismissed trainer Rick Dutrow's appeal against his suspension, finding "no substantial constitutional question is directly involved", reports bloodhorse.com. Dutrow initially faced a 90-day suspension when the painkiller butorphanol was found in the urine of Fastus Cactus after an Aqueduct race in November 2010. This was later upgraded, and the subsequent 10-year ban is the second harshest ever handed out by the Board. Dutrow's lawyer Michael Koenig said the trainer intends to make one more attempt "with the Court of Appeals to challenge the mid-level court's findings." Dutrow has a stay, allowing him to remain training, provided the next appeal is filed with the high court in the next 21 days.
